How Long Do Families Have to File a Wrongful Death Claim in Connecticut?
Families generally have two years from the date of death to file a wrongful death claim in Connecticut. This time limit is set by state law, and missing it may prevent a case from moving forward. Courts apply this rule strictly, and late filings are often dismissed without review.
A separate five-year limit may also apply based on when the underlying event occurred. This rule can act as a strict outer boundary, even if key facts are discovered later or new details come to light. It limits how long a claim can exist regardless of when information becomes available.
Only the estate’s executor or administrator can file the claim. This person must be formally appointed through probate court before taking legal action on behalf of the deceased. Without this appointment, courts will not allow the case to proceed.
Compensation in wrongful death cases may include medical costs, lost income, and the loss of life. Each category depends on the specific facts and supporting records presented during the case. Courts evaluate documentation carefully when determining what damages may apply.
A wrongful death lawyer can review timelines and determine which deadlines apply. Legal guidance helps reduce the risk of missing important filing limits and ensures the process follows required procedures.
